Golden Plains XI - Terms and Conditions

A. The Event Terms and Conditions.

All Prices quoted are in Australian Dollars and include local taxes (GST).

Please be aware that a ticket (referred to as a Festival wristband) to an event at the Meredith Supernatural Amphitheatre cannot be sold, re-sold, attempted to be re-sold, transferred or attempted to be transferred for profit or commercial advantage. If this occurs the Festival wristband and all other Festival wristbands in the same order are voidable and the Festival wristband holder/s may be refused entry to or be ejected from the Festival site or handed over to Police. Aunty’s re-sale facility is the only authorised re-sale facility. Please also be aware that ballot codes to purchase tickets to an event at the Meredith Supernatural Amphitheatre cannot be sold, attempted to be sold or attempted to be transferred for profit or commercial advantage. If this occurs the ballot code and any associated tickets will be voidable and sellers will be blacklisted from future ballots.

This Festival wristband is sold or gifted by MMF Pty Ltd, ABN 15157031720. Purchase of this Festival wristband constitutes a contract between MMF Pty Ltd, the purchaser and, in the event that the Festival wristband is purchased on another’s behalf or gifted, the Festival wristband holder. Wristbands are sold subject to the following terms and conditions which form part of the contract between MMF Pty Ltd, the purchaser and the Festival wristband holder.

The Terms and Conditions of Sale include the following.

1. A change in personal circumstances of the Festival wristband holder does not entitle the return or exchange of the Festival wristband.

2. Festival wristbands will not be refunded under any circumstances, including but not limited to, the possible non-appearance of any particular person or group expected by the Festival wristband holder, whether advertised or not, or any adverse weather conditions beyond the reasonable control of the event organiser. Programming is subject to change at any time without notice.

3. Lost, stolen or damaged Festival wristbands will not be replaced.

4. Festival wristbands only provide access to the areas as indicated by signage at the event.

5. Professional audio visual cameras (including but not limited to all cameras with a detachable lens) are only permitted with written permission from the Festival publicist. A copy of the written permission must be presented at the time of a request by Festival staff; failure to do so will result in the equipment being cloaked until the end of the Festival. MMF Pty Ltd reserves the right to classify an audio visual device as a professional camera and/or as a device used for a professional purpose and therefore a banned item. MMF Pty Ltd reserves the right to remove a Festival wristband holder if they are in breach of the requirements regarding audio visual equipment.

6. Festival wristbands must be worn at all times around the wrist of the Festival wristband holder when at the Meredith Supernatural Amphitheatre during gate open times. Festival wristbands are strictly not transferrable and cannot be shared. All visitors are required to stop and show their wristband when requested by Festival staff.

7. Entry to the Meredith Supernatural Amphitheatre is only permitted to Festival wristband holders who agree to have their vehicle searched on entry for glass, gas bottles and other banned items.

8. Entry to the Meredith Supernatural Amphitheatre is only permitted to Festival wristband holders who agree to the terms and conditions and the Festival policies, viewable at goldenplains.com.au. The Festival policies include but are not limited to the trespasser policy, no dickhead policy, amphitheatre furniture policy, kids/all ages, campsite noise and nuisance policy, what to bring, banned items and gates times. MMF Pty Ltd reserves the right to evict any person who does not comply with the terms and conditions and/or does not comply with the Festival policies and/or is involved in an illegal activity.

9. MMF Pty Ltd has the right to use any photos, film or other recordings taken of people or things whilst attending the Festival for presentation, promotional or other MMF Pty Ltd purposes in perpetuity.

10. Transport to and from the Meredith Supernatural Amphitheatre will be operated by independent parties. MMF Pty Ltd accepts no liability for any action or omission by such parties.

11. Some of the artists appearing may use lyrics, language, gestures or symbols whilst entertaining that some people may find offensive. If such language or behaviour may concern you, please do not attend.

12. Children under 10 are free. Everyone else needs a Festival wristband to gain entry. Persons under 18 must be accompanied by a Legal Guardian at all times. There are no concessions or discounts. These terms and conditions and the Festival policies apply also to persons under 18.

13. MMF Pty Ltd takes no responsibility for loss or damage to personal property.

14. If you have a viral or bacterial illness please stay at home, to keep from infecting others.

15. Festival wristband holders acknowledge that participating in an event at the Meredith Supernatural Amphitheatre has inherent dangers and risks including a risk of serious injury or even death. In the event of injury or illness MMF Pty Ltd may, at the cost of the Festival wristband holder, arrange medical treatment and/or emergency evacuation as deemed essential for the safety of the Festival wristband holder.

16. Entry is at the Festival wristband holder’s own risk. Without limiting the generality of this, appropriate footwear and clothing must be worn at all times on the site and ear plugs should be worn if necessary and MMF Pty Ltd takes no responsibility for any hearing damage or loss caused by excessive noise.

17. Swimming in the dams or elsewhere is strictly not permitted.

18. To the full extent permitted by law, Festival wristband holders waive all legal rights of action against and fully release MMF Pty Ltd, its agents, employees, members and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the Festival wristband holder’s participation in the event including without limitation, liability for any negligent or tortious act or omission on the part of the persons released or under statute or for breach of these terms and conditions.

WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this notice.

NOTE: The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. "Gross negligence" is defined in the Fair Trading (Recreational Services) Regulations 2004.

B. Merchant Terms and Conditions Of Sale

Who you are buying from
1. This web site is owned and operated by MMF Pty Ltd (ABN 15 157 031 720) trading as Golden Plains Festival of PO Box 1347, Collingwood Victoria Australia 3066 ( 'We', 'Our' or 'Us'). We sell tickets offered via this website as the event organisers ('Promoter') and any tickets purchased from this website are purchased from Us as the Promoter. Any dispute you have relating to an event or ticket purchase is between you and us.

2. We have engaged Oztix to provide a software platform and related services to facilitate sales of tickets. Oztix are not selling the tickets nor acting as agent or merchant for the Promoter.

3. The Promoter nor Oztix are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.

What you are agreeing to
4. By visiting, using or purchasing any tickets via this website you agree to be bound by these Terms and Conditions and Our Privacy Policy.

5. Every ticket sold through this web site is also subject to:
a. the Promoter’s additional event term and conditions (please see above);
b. any terms and conditions of the venue at which event is held (please see the venue’s website); and
c. any terms and conditions that may be printed on the ticket.

6. The Promoter reserves the right to add, withdraw, reschedule or substitute artists and/or vary programs, prices, venues, seating arrangements and audience capacity.

Use of this Web Site
7. Use of this web site is restricted to personal use and reference only.

Conditions of Sale
8. All Prices quoted are in Australian Dollars and include local taxes (GST).

9. Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or usually 2 hours before doors open for the event.

10. The Promoter reserves the right not to sell tickets to any person, agent or company.

11. Tickets will be delivered to you by the method you select during the booking process. If tickets are sent using Registered Post or a Courier service they will only be sent to addresses where the purchaser can sign for delivery. Mail delivery option will cease to be offered 7~10 days before the event.

12. Tickets may not, without the prior consent of the Promoter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder.

13. Notwithstanding these terms and conditions, if You use a “disposable” or “temporary” credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to you unless a) you can provide full details of the credit card; b) the credit card remains valid; and c) you can produce the online purchase receipt.

14. Note: your Credit Card statement will itemise a purchase as a charge from "MMF Pty Ltd, MEREDITH".

Refunds and exchanges
15. The Promoter will only refund tickets in accordance with these terms and conditions and to the extent permitted by law. The Promoter or Oztix has no liability to you.

16. We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances. We reserve the right to charge you a reasonable fee for the replacement of tickets. Please treat your tickets like cash, as we cannot replace lost tickets.

17. The Promoter reserves the right to alter the date, the venue and the entertainment and activities as advertised, without prior notice to you. Your entitlement to a refund in such circumstances is determined by the Promoter. Please contact Promoter directly here in order to determine your eligibility for a refund.

18. If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.

19. If We authorise a Refund, We will refund to you the Ticket Price, the Booking Fee, the Processing Surcharge and if applicable any Delivery fees charged for and tickets were not dispatched.

20. Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.

21. We will post any relevant information regarding any cancelled or rescheduled events on our website when applicable. It is your responsibility to check our website for information in relation to any events.

No Show / Failure to collect tickets / Delivery fulfilment
22. We fulfil Our commitment to you for the sale of tickets by either mailing or emailing the ticket to you, or by making the ticket available at the door or Box Office for you to collect.

23. If you have elected to receive the tickets by mail or email and have not received your ticket(s) within 48 hours of the event, please contact auntym@mmf.com.au.

Changes to Terms and Conditions
24. The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, We may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the web site.

25. You should periodically check this page of the web site to ensure that you are aware of the latest terms and conditions.

What happens if you have an enquiry or complaint?

Data Security
29. When We process your order We collect your credit card and personal information in accordance with Our Terms and Conditions, our Privacy Policy and our Privacy Collection Notice.

30. If you are concerned about using your credit card online please contact us for assistance.

31. If you deny or dispute a charge on your credit card made by us, please contact us immediately. We consider credit card fraud to be a serious offence and we aim to prosecute each case to the fullest extent possible.

32. The images, text, logos and artwork contained within this site are copyright to Promoter, Oztix and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited. The Oztix logo is a registered trademark.

Disclaimer and liability
33. You accept that the Internet is not always a reliable and that system outages may occur.

34. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, We or Oztix will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your purchase of any tickets or your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not We know of the possibility of such damage.

Choice of Law
35. These Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but legal proceedings may be commenced in any Australian State or Territory.

Australian Consumer Law
36. Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
